A Border Patrol agent was assaulted Sunday while arresting a suspected border crosser in Nogales, the agency said.
A 25-year-old Mexican man was scaling the border fence and kicked the agent in the head multiple times while the agent tried to arrest him, the Border Patrol's Tucson Sector said in a news release Monday.
The agent was evaluated at a local hospital for injuries after arresting the fence-climbing man, who will be processed for immigration violations and charged with assault by the U.S. Attorney's Office, the agency said.
The agent was patrolling an area known as "Smugglers Overwatch" in Nogales when he responded to a seismic sensor alert, according to a criminal complaint filed Monday in U.S. District Court in Tucson.
Another agent also responded to the sensor alert and saw the man, identified in the complaint as Mario Guzman Ortiz, running south towards the border fence.
As Guzman tried to climb the fence, he kicked one of the agents at least twice on the left side of the agent's face before he was subdued.
