The Department of Justice has released the indictment against Heraclio Osorio-Arellanes, the sixth of seven men charged in the 2010 killing of border agent Brian Terry near Nogales.
Mexican navy officers apprehended Osorio-Arellanes in Mexico on Wednesday near the border between the states of Sinaloa and Chihuahua, officials have said.
“To anyone who would take the life of an American citizen, in particular an American law enforcement officer, this action sends a clear message: Working closely with our international partners, we will hunt you down, we will find you, and we will bring you to justice,” said Attorney General Jeff Sessions, in a news release.
Sessions thanked Mexican officials who worked with American law enforcement on the capture of Osorio-Arellanes.
Osorio-Arellanes will be taken to Mexico City for extradition.
Ivan Soto-Barraza and Jesus Lionel Sanchez-Meza were convicted of first-degree murder and other offenses in December 2015 after a trial.
Manuel Osorio-Arellanes and Rosario Rafael Burboa-Alvarez pleaded guilty to first degree murder. Rito Osorio-Arellanes pleaded guilty to conspiracy to interfere with commerce by robbery.
Jesus Favela-Astorga remains a fugitive in Mexico.
Terry was on a stakeout in the hills near Nogales on a mission to find "rip-off" crew members who rob drug smugglers. He was struck in the back when gunman fired at the border agents.
