South Tucson City Council recall election

There is only one major item on the South Tucson City Council agenda tonight — Monday, Oct. 23: The recall election of Mayor Ildefonso Green and three Councilmen.

This isn't deja vu — the Council did sign off on the same recall election roughly two weeks ago.

However, a clerical error that cites a section of state law that doesn't exist is forcing the Council to meet again . The original action cites 16-209(a) while tonight's agenda correctly states the correct statute — 19-209(a)(b)(c) — related to recall elections.

Tonight's meeting helps the city guard against any future legal complaints, with concerns a legal challenge could derail recall efforts. The election is expected to be held on March 13, 2018.

Kory Langhofer, a managing attorney with the Phoenix-based Statecraft law firm, doesn't believe a legal challenge is likely. He was confident that even if the city were challenged in court, a judge would side with city officials and allow the recall election to go forward.

He said the mistake amounts to a minor error, and the city made a good faith effort to call for a recall election as spelled out under state laws.

The recall effort targets Green and councilmen Rufino Cantu, Robert Larribas and Carlos Romo.
