Probation officials will now track former DEA agent Joseph Bongiovanni through a smartphone app, rather than a GPS ankle monitor.

The bribery and corruption retrial of former Drug Enforcement Agent Joseph Bongiovanni is scheduled to begin July 29, according to one of his defense attorneys and the U.S. Attorney's Office.

Bongiovanni's trial will remain separate from the trial of Peter Gerace Jr., the owner of Pharaoh's Gentlemen's Club, said Bongiovanni defense attorney Parker R. MacKay.

Federal prosecutors said they would have likely moved to rejoin the trials if Bongiovanni's was not scheduled for late July or early August, MacKay said.

The retrial date was first reported by WIVB-TV.

A jury in Bongiovanni's first eight-week trial delivered a partial verdict on April 12, finding Bongiovanni guilty on one count of obstruction of justice and one count of lying to federal agents, both counts involving a case file kept in his home after his retirement.

Jurors acquitted Bongiovanni of deleting data on his DEA-issued cellphone when he retired. Jurors did not reach a verdict on 12 other charges, including charges that he protected members of the Ron Serio drug-trafficking organization from arrest and alerted them of informants, as well as other counts involving Gerace. U.S. District Judge Lawrence J. Vilardo, who will oversee the retrial, declared a mistrial on those counts.

Gerace is expected to face trial later this year on charges including bribing Bongiovanni, drug trafficking and sex trafficking.
