This policy is based on the legality of Obama's Deferred Action for Childhood Arrivals executive order, if you do not believe the president has the right to unilaterally set immigration policy for one set of people who arrived in the country illegally then the court must decide with the people of Arizona who want state benefits saved for legal residents or citizens of Arizona. If, however, you believe the president has the right to ignore Congress and make up his own immigration policies, then the DACA students are now temporary legal residents and entitled to in-state tuition.
