Pasadera Behavioral Health Network wants a Pima County Superior Court judge to reverse recent zoning decisions so it can open an adult drug-treatment facility in South Tucson.

The health network has been at odds with the city of South Tucson since the beginning of the year, when then-City Manager Benny Young indicated the city would not allow Pasadera to open the treatment center directly across the street from Mission View Elementary School.

Attorneys representing the health network argue the city failed to provide any legal basis for rejecting their zoning request.

The company is trying to open in the same location where the Arizonaโ€™s Children Association had been operating, according to court filings, since 1921. Pasadera purchased the property in December for slightly more than $2 million.

The fight is over interpretations of the cityโ€™s zoning code, which allowed the childrenโ€™s group to operate a similar residential facility in the same location.

City officials have publicly stated Pasadera had changed the use of the facility when opting to treat adults rather than children, and lost its rights to operate such a facility next to a school.

A representative for the city declined to comment on the claim, citing a policy not to discuss ongoing legal matters.
