A driver accused of purposely striking and killing a pedestrian with his pickup truck, pinned the man against a wall after he "gunned" the vehicle toward him, a court document says.

The incident happened about 5 p.m. Sept. 28, after police say Eric Schumeister, 53, got into an argument with a man near his home in Barrio Anita, a historic neighborhood near West Speedway and Interstate 10.

Police have identified the man who was fatally struck as Michael Guillen, 48.

Guillen was walking on North Contzen Avenue at the same time Schumeister was backing out of his driveway. They "had words" before Guillen continued walking to a vacant dirt lot where other people were gathered, according to a complaint filed in Pima County Justice Court.

Schumeister drove his truck into the lot and stared the victim down and the men argued.

Schumeister then pointed his vehicle, a 2004 Ford F-350, toward Guillen and “gunned it” through the dirt lot. The truck violently struck Guillen, pinning him against a freeway ramp wall, police said.

Schumeister then backed up and “smeared” Guillen against the wall, witnesses told police.

A short time later, Schumeister returned to his home, but refused to come out for police officers. Schumeister surrendered to police after two hours of negotiation, police have said.

Guillen sustained a crushed pelvis and his heart stop several times during efforts to save his life, the court document says.

Schumeister was arrested on suspicion of murder. Bond was set at $1 million.
